Resumption of Primary Policing by the East Timor National Police

Press Release The Government of Timor-Leste and UNMIT start the resumption of primary policing responsibilities by PNTL 13 May 2009, Dili - Prime Minister Kay Rala Xanana Gusmao and Special Representative of the Secretary-General of the United Nations (SRSG) for Timor-Leste Atul Khare today decided that the resumption of primary responsibilities for the conduct of police operations by Policia Nacional de Timor-Leste (PNTL) will commence in the District of Lautem on 14 May 2009.

UNMIT and the Government of Timor-Leste reached an agreement which provides a basic framework for the resumption process and clarifies the roles and responsibilities of the PNTL and UN Police during the Consolidation Phase. The agreement ensures that the resumption process is jointly-owned and implemented.

In addition, Prime Minister Gusmao and SRSG Khare agreed that appropriate action will be taken by the Timorese authorities in accordance with applicable laws and procedures on all non-certified PNTL members.

The Government of Timor-Leste and UNMIT are implementing the resumption process in a gradual manner based on joint assessments on the preparedness of PNTL in each District and Unit, in accordance with mutually agreed criteria. The UN Police will maintain their presence in the Districts where the PNTL have resumed responsibilities, in order to support, provide
advice and to monitor the PNTL, including in the area of human rights protection.

Comunicado da Imprensa O Governo de Timor-Leste e a UNMIT iniciam a retoma das responsabilidades primárias de policiamento por parte da PNTL

13 de Maio de 2009, Díli – O Primeiro-Ministro, Kay Rala Xanana Gusmão, e o Representante Especial do Secretário-Geral das Nações Unidas (RESG) para Timor-Leste, Atul Khare, decidiram hoje que a retoma das responsabilidades primárias pela condução de operações policiais por parte da Polícia Nacional de Timor-Leste (PNTL) se iniciará no Distrito de Lautém a 14 de Maio de 2009.

A UNMIT e o Governo de Timor-Leste celebraram um acordo que estabelece um quadro geral para o processo de retoma das responsabilidades e que esclarece os papéis e responsabilidades da PNTL e da Polícia das Nações Unidas durante a Fase de Consolidação. O acordo celebrado garante a apropriação (ownership) e implementação conjuntas do processo de retoma
das responsabilidades.

O Primeiro-Ministro Xanana Gusmão e o RESG Atul Khare acordaram igualmente que as autoridades timorenses tomarão as medidas adequadas relativamente a todos os elementos não-certificados da PNTL em conformidade com as leis e procedimentos aplicáveis.

O Governo de Timor-Leste e a UNMIT estão a implementar o processo de retoma das responsabilidades de um modo gradual, baseado em avaliações conjuntas do grau de preparação da PNTL em cada Distrito e Unidade, e em conformidade com critérios que foram conjuntamente acordados. A Polícia das Nações Unidas manterá a sua presença nos Distritos onde a PNTL tenha
retomado as suas responsabilidades, a fim de apoiar, aconselhar e monitorizar o desempenho da PNTL, inclusivamente na área da protecção dos direitos humanos.

Image added by ETLJB: Less than 3 years ago, on 25 May 2006, the East Timor National Police (PNTL) were the subject of a massacare perpetratd by soldiers from the East Timor Defence Force (F-FDTL) in which 12 officers were murdered. The force dissipated in the wake of the 2006 disintegration of the rule of law.

Accusations of human rights abuses against the PNTL by Human Rights Watch, confusion and mismanagement of the relationship between PNTL and the United Nations Police in East Timor as well as unconstitutional alliances between the PNTL and the F-FDTL in security operations all raise the question whether the PNTL is really ready to resume full policing responsibility in East Timor.
