Once again the National Parliament has cancelled an overseas trip by the President of the Republic:

JSMP requests for the National Parliament to end the debate over the list of candidates for members of government that is still pending before the courts

On 23 October 2018, through a plenary meeting of the National Parliament, the members of parliament once again did not give authorisation to the President of the Republic to travel overseas to the neighbouring country of Indonesia.

During the discussion and vote on a request regarding the visit of the President of the Republic, there were those in favour and against, from the Parliamentary Majority Alliance (AMP) and the opposition. The outcome of the vote was 19 in favour, 31 against and 0 abstentions from a total of 50 MPs who were present. The MPs who voted against were from AMP.

“JSMP is very concerned with the dynamics and political developments in the National Parliament recently, because the political climate remains unhealthy and unsafe in the interests of the people. These policies will have serious implications on political and institutional relationships and communications with the President of the Republic because they undermine the relationships between the sovereign organs and will affect the life of the nation and ordinary citizens”, said the Executive Director of JSMP, Luis de Oliveira Sampaio.

JSMP understands that these practices reflect the spirit of the norms provided in the Constitution regarding “checks and balances” but these mechanisms need to be exercised in a healthy, responsible, dignified manner and most of all should protect the national interest and promote good governance, not for political reasons that are counterproductive.

If MPs from AMP are expressing political dissatisfaction in relation to the list of candidates for members of government that still remains pending, then JSMP requests for the MPs in the National Parliament, especially the MPs from AMP, to use the legal and constitutional mechanisms provided for in the law to challenge the decision of the President of the Republic in order to end this debate/polemic.

JSMP has observed that the solution promoted by the Prime Minister, Taur Matan Ruak and the President of the Republic, Francisco Guterres “Lu-Olo” to use dialogue has not been acknowledged and received positively to date because each party is maintaining their respective position. In a democratic nation based on the rule of law the right, appropriate and legitimate solution is a court decision, to avoid political options that are unsafe for the nation and this fledgling system of democracy.

The members of parliament might have their own assessments and political convictions, but JSMP believes that there is no urgent and exceptional need to blcok the President of the Republic from travelling overseas, especially as this is the third time. This policy has no basis because the political situation has been almost normal since the President of the Republic promulgated the 2018 State Budget on 27 September 2018.

During the vote the opposition benches expressed strong criticism and disappointment with the policy of the MPs from AMP who voted against this visit. The Opposition Party of PD when declaring its vote considered this decision to be a political one that is unfavourable for our nation. The PD Bench noted that the other organs, such as the President of the National Parliament, have travelled overseas whenever they like, whilst the President of the Republic continues to be blocked by the members of the National Parliament. This has created a precedent that will have political complications for our nation in the future. What is the reason for again blocking the trip of the President of the Republic? The PD Bench outlined that they don’t know for how long the MPs from AMP will continue with this policy of impeding each other.

Previously PD had only 8 votes for the President Minister Taur Matan Ruak to visit Japan, said MP Adriano when declaring the votes.

The FRETILIN Bench also expressed disappointment with this decision when declaring the votes. MP Antonino Bianco said that he has only just recently experienced the feelings of hatred towards Fretilin or this historical leader. MP Bianco added that this is the only time that the President of the Republic, the Chief of State, has been hated in this country. From all of the countries in the world, it only happens in Timor-Leste.

Although the AMP Bench did not declare its vote in the plenary, through an interview with the media, an MP from AMP, Mr. Patrocínio Fernandes dos Reis, said that the President of the Republic’s trip is important but does not mean that domestic problems are not important. There is no concern about the bilateral relations between the two countries, because the role of the Government is to engage in diplomacy between the countries. The visit of the President of the Republic is not to engage in diplomacy but to ensure a good image by representing the State overseas.

Polemic on Appointment of Government: Observer suggests taking to Court

The disagreement on the appointment of nine members of the government cabinet has caused tension between Timor-Leste’s President and the government-ruling party, Alliance of Change for Progress (AMP).

On June 22, President Lu-Olo refused to swear in nine nominations of AMP coalition party because of their involvement in corruption investigations. As a response to President of the Republic, Francisco Guterres Lu-Olo’s refusal of the nine nominees, AMP in parliament has blocked President Lu-Olo’s overseas visit plan three times in row including Tuesday’s cancelation of President’s plan to participate in Bali Democracy Forum.

With the fourth cancelation of President Francisco Guterres Lu-Olo’s overseas visit is underway – President is scheduled to travel to Vatican on November 3, 2018, Political Observer, Camilo Ximenes suggests taking the polemic of the blocked nominations to the Court of Appeals to resolve it.

“Both parties – AMP and President - could take it to the court to resolve it if one of the parties feel that it is not fair,” Ximenes said.

He added the political problem could never be resolved if both parties did not want to give in, but they could resolve it with legal proceedings to end the polemic.

The deadlock over the blocked nominations is seven people from the National Congress of the Timorese Reconstruction (CNRT): Francisco Kalbuadi Lay, Helder Lopes,Tomás do Rosário Cabral, Vergilho Smith, Jacinto Rigoberto Gomes de Deus, Sérgio Gama da C. Lobo, Amândio de Sá Benevides and two José Manuel Soares Turquel de Jesus and António Verdial de Sousa who are from coalition's other partner KHUNTO.

Clash in Balide leaves a young man seriously injured

GMN Diário Nacional, October 24, 2018 Language source: Tetun Clash between young people in Balide, Dili Tuesday has left a young man named Jacinto Dos Santos seriously injured.

The victim is currently getting medical treatment at National Hospital of Guido Valadares.

A community said on Monday two groups of young people had stoned each other and police had detained one of the suspects, but on Tuesday they continued stoning each other.

“The victim rode a motorbike and he came from Santa Cruz area, when he reached the front of Balide Church, a group of young men attacked him with stones and when he fell down, they continued stoning beating him up with hammer,” a bystander who did not want to be named told reporters Tuesday.

He added the incident happened in front of police station, but the police did not come out to help the victim.

In addition, the victim’s family lamented because the incident happened in front of police station, but the late response from the police had left the young man seriously injured. GMN tried to confirm the issue with Balide Police Station, but they refused to comment, saying the case was under investigation.

Parliament cancels President Lu-Olo’s visit to Indonesia

National Parliament (PN) through a plenary session Tuesday has canceled President of the Republic Francisco Guterres Lu-Olo’s plan to participate in Bali Democracy Forum in Bali of Indonesia.

President Lu-Olo was invited by Indonesian President Joko Widodo to participate in Bali Democracy Forum, but PN did not authorise it because 31 PN members have voted against the plan and only 19 members voted in favour. With this cancellation, parliament has canceled Lu-Olo’s overseas visits for the third time. In September and July, PN canceled Lu-Olo’s visits to Portugal and New York.

Addressing parliament after the cancelation, David Dos Ximenes, from Fretilin party, said sensibility of PN members from Alliance of Change for Progress (AMP) had died because they had cancelled the President’s overseas visits several times.

“Last month, you (AMP members, red) canceled President’s visit to New York because President had not yet promulgated 2018 State Budget, but now? President has promulgated the state budget, why did you cancel his overseas visit?” he said.

Meanwhile, Patrocino Fernandes, from CNRT Party – one of the AMP Coalition party, said they did not authorise President Lu-Olo’s visit to overseas because there was domestic issues that needed to be addressed by President of the Republic. “We did not authorise President’s overseas visit because of political reasons.

There are nine nominations of government members have not yet inaugurated,” Fernandes said.

President's appointment of Deputy General Prosecutor questioned

The appointment of new Deputy General Prosecutor (PGR) by President of the Republic Francisco Guterres Lu-Olo has caused polemic with many called on President Lu-Olo to reverse his decision.

Responding to the polemic, a member of Superior Council of Public Prosecutor (KSMMP), Sergio Hornai, said President of the Republic nominated the new Deputy General Prosecutor based on proposal from KSMMP.

“KSMMP proposed three people, it means all of them are admissible, therefore, there is nothing wrong with the appointment of Alfonso Lopez as new Deputy General Prosecutor,” Hornai told reporters outside Presidential Palace on Wednesday (24/10).

Civil society organisations have been criticising President of the Republic, Francisco Guterres Lu-Olo for nominating second class prosecutor Alfonso Lopes as new Deputy General Prosecutor, saying it violated General Prosecutor’s statutes.

Government to Establish Military Court under auspices of District Courts

ETLJB Editor's Note: In view of the problematical behaviour of defence force personnel over the years, it is high time that the Military Courts were established. 

It seems that, administratively, the Court will operate under the auspices of the civil District Courts. In my view, they should be constituted separately to all other courts.

1. It is incumbent upon military courts to judge in first instance crimes of military nature.
2. The competence, organisation, composition and functioning of military courts shall be established by law.

The Timorese Government through the Ministry of Defense has planned to establish military court in 2019.

Minister of Defense Filomeno Paixão said military crimes should not be put on trial in civil court because it was difference with civil crimes and related with military codes.

“It does not need big amount of money to set up a military court, we can set up a military court under district court to process military cases such as selling guns and bullets or hunting wild animals with the state-owned guns by military officers, and many other cases,” he told reporters outside Government Palace recently.

He added the military court did not need military judges and prosecutors, they could be normal judges and prosecutors, they only needed military codes.ENDS


East Timor National Parliament denies President permission to leave the country

President of the Republic Francisco Guterres Lu-Olo accepted and respected National Parliament (PN)’s decision of cancelling his planned overseas visit to participate in International Democracy Forum in Bali of Indonesia, but he also hinted at interdependence of powers between state bodies.

The visit’s rejection, which received 31 votes to 19 on Tuesday, followed parliament denying the President’s attendance at the UN General Assembly in New York last month and also a state visit to Portugal in July.

Addressing media at Presidential Palace on Wednesday, President Lu-Olo said it was under parliament’s competence whether to authorise his foreign visit or not, but he also called on parliament to be ready and accept his decision when it was time for President of the Republic to exercise his competences. “It is their competence whether to authorise or not, but President of the Republic also has competences and other state bodies should not interfere,” he warned.

Responding to parliament’s call for prioritising domestic issues over international affairs, President Lu-Olo reminded parliament of one of the roles of President of the Republic was to strengthen bilateral ties with foreign countries.

“The pending nominations is our internal problem (…) we should not use it as a political payback to President of the Republic which in process strains our relations with other countries,” Lu-Olo said.

Timor-Leste: Pengunduran Diri Presiden

Rentangan, penyimpangan dan situasi dystopic dari pemerintah terus berlanjut, yang disebabkan oleh seorang Presiden yang, dengan kesalahan penilaian yang parah, secara salah dan tidak konstitusional menyangkal fungsi pemerintah.

Seringkali, solusi masalah kompleks dicapai melalui proses yang sederhana.

Menimbang bahwa Presiden dengan tegas menolak penunjukan resmi tidak kurang dari sembilan calon Menteri yang dinominasikan oleh Perdana Menteri dan lebih jauh mengingat pengamatan saya sebelumnya tentang ketidakkonstitusionalan perilaku Presiden, mari kita lihat beberapa ketentuan lain dari Konstitusi yang mungkin menjadi relevan atau setidaknya harus dipertimbangkan oleh semua orang, tetapi terutama Yang Mulia sendiri.

Karena ia menemukan dirinya pada tingkat ketidaksesuaian seperti dengan Parlemen dan Pemerintah yang dipilih secara demokratis, tidak dapat melaksanakan tanggung jawab konstitusionalnya, telah membahayakan pemerintahan yang stabil dengan mengorbankan rakyat yang mengharapkan Perdana Menteri dan para Menterinya untuk memerintah, tetapi, pada akhirnya, tidak dapat melampaui ideologi politik yang menyebabkan perilaku bermasalahnya, telah menunjukkan ketidakmampuan untuk berfungsi sebagai Presiden yang patuh secara konstitusional, maka satu pilihan baginya adalah mengundurkan diri dari jabatannya.

Untungnya, Konstitusi membuat ketentuan untuk pengunduran diri sukarela dari Presiden.

Pasal 81
(Pengunduran Diri dari Jabatan)
1. Presiden Republik dapat mengundurkan diri dari jabatannya melalui pemberitahuan yang disampaikan pada Parlemen Nasional.
2. Pengunduran diri menjadi resmi apabila pemberitahuannya telah diketahui oleh Parlemen Nasional, tetapi pengunduran diri tersebut tetap harus diumumkan dalam Lembaran Negara.
3. Apabila Presiden Republik mengundurkan diri dari jabatan, dia tidak akan diperkenankan untuk mencalonkan diri baik pada pemilihan presiden yang segera diadakan setelah pengunduran dirinya maupun pada pemilihan biasa yang akan diselenggarakan setelah lima tahun. 

Dalam kasus pengunduran diri, Konstitusi lebih lanjut mengatur fungsi kepresidenan untuk diberikan kepada Ketua Parlemen Nasional:

Pasal 82
(Kemangkatan, Pengunduran diri atau Kecacatan Tetap)
1. Apabila Presiden Republik mangkat, mengundurkan diri atau menyanggang cacat tetap, fungsi-fungsinya akan dijalankan sementara oleh Presiden Parlemen Nasional, yang akan dipersumpahkan oleh anggota Parlemen yang akan menjabat sebagai Presiden Parlemen Nasional sementara, dihadapan Anggota-anggota Parlemen Nasional dan wakil-wakil dari lembaga-lembaga kedaulatan lainnya.

Pemerintah berhak memerintah. Mereka yang menolak pemerintahan yang demokratis ini sangat bertentangan dengan gagasan sentral demokrasi bahwa satu-satunya pilihan adalah mengundurkan diri.

Ini kemudian akan memungkinkan Parlemen untuk menyelesaikan kesenjangan di dalam Pemerintah.

Ini tidak masuk akal atau juga merupakan yurisprudensi demokratis yang baik bahwa Pemerintah yang memiliki mayoritas di Parlemen digagalkan dari pemerintahan oleh Presiden bertindak jauh melampaui legitimasi konstitusionalnya.

East Timor: The Resignation of the President

"Fortunately, the Constitution makes provision for the voluntary resignation of the President."

The contortions, perversions and dystopic situation of the government continues, caused by a President who, by grave error of judgment, wrongfully and unconstitutionally denies the government functionality.

Oftentimes, the solution of a complex problem is achieved through a simple process.

Considering that the President obstinately refuses the formal appointment of no less than nine Ministerial candidates nominated by the Prime Minister and further recalling my earlier observations about the unconstitutionality of the President's conduct, let us look at some other provisions of the Constitution that might become relevant or at least should be considered by everyone, but especially the His Excellency himself.

Since he finds himself at such a level of incompatibility with the democratically elected Parliament and Government, unable to discharge his constitutional responsibilities, has compromised stable governance at the expense of the people who expect their Prime Minister and his Ministers to rule, but, ultimately, unable to transcend the political ideology that is causing his problematical behaviour, has demonstrated incompetence to function as a constitutionally-compliant President, then one option is for him to resign from office.

Fortunately, the Constitution makes provision for the voluntary resignation of the President.

Article 81 (Resignation of Office) 
1. The President of the Republic may resign from office by message addressed to the National Parliament. 
2. Resignation shall take effect once the message is made known to the National Parliament without prejudice to its subsequent publication in the official gazette. 
3. Where the President of the Republic resigns from office, he or she shall not be eligible to stand for presidential elections immediately after resignation nor in the regular elections to be held after five years.

In the case of resignation, the Constitution further provides for the presidential functions to be vested in the Speaker of the National Parliament:

Article 82
(Death, resignation or permanent disability)
1. In case of death, resignation or permanent disability of the President of the Republic, his or her functions shall be taken over on an interim basis by the Speaker of the National Parliament, who shall be sworn in by the Speaker a.i. of the National Parliament before the Members of the National Parliament and representatives of the organs of sovereignty. 

The Government is entitled to govern. Those who resist this democratic governance are at such odds with the central ideas of democracy that the only option is to resign.

This would then enable the Parliament to resolve the gaps in the Government.

It makes neither common sense nor does it constitute good democratic jurisprudence that a Government that has a majority in the Parliament is thwarted from governing by the President acting far beyond his constitutional legitimacy.

"before the victim died the victim was assaulted by a person with a pillow who smothered her mouth and nose and the victim could not breathe until her lungs burst and this killed the victim. The court found that the victim died because she was hung up by someone in the house,.....The court also found that the victim had injuries to her mouth and throat."

JSMP has published its Case Summary The Dili District Court August 2018. Included in the Case Summary is a case of aggravated homicide where it was alleged that the husband had murdered his wife. The case number is 0049/15.PGGC. The following is an extract from the Case Summary relating to this matter.

"On 31 August 2018 the Dili District Court conducted a hearing to announce its decision in a case of aggravated homicide involving the defendant CGP who allegedly committed the offence against the victim HS (deceased), his wife, in Dili District.

Charges of the Public Prosecutor

The public prosecutor alleged that on 7 October 2014 the defendant and the victim argued about a WhatsApp (WA) message that the victim received from the victim's former boyfriend that he still kissed the victim's photograph in his bedroom. After reading this message the defendant immediately left the house.

On 8 October 2014, at approximately 7am, the defendant returned home and again argued with the victim about the message he saw on the victim's WA and said “you are not ready to be with a man”. The victim responded to the defendant by saying “Be quiet, you hypocrite”.

Law by Blood and Death: Customary Law in East Timor

This note is a short account of the author’s experience of a customary law-making process in East Timor in 2001.

The whole village, including children, and guests, sat in a circular formation around the centre of the village totem. Tied to the totem were a cow, a dog, a pig and several chickens. There was a blue plastic bucket and coconut palm leaves cut into sections.

The ceremony began. I will only describe the events that I witnessed because I was unable to understand the language although there was an English interpretation that summarised what was happening. I and several of my international colleagues as representative of the UNTAET Land and Property Unit had been invited to attend and witness this law-making process by the village chief.

The purpose of the ritual was to enact a new law for the village’s territory and that law was that no more trees were to be cut down. Deforestation had ravaged the landscape all over East Timor during the Indonesian military occupation. Sandalwood tree forests had been overexploited almost to the point of eradication.

The animals represented the penalty that anyone would have to pay if they cut down trees.

One of the village officials drew back his katana and plunged it into the cow’s neck. The cow screamed, dropped to its knees with blood gushing from the wound. It continued to wail in its death throes until there was silence.

Next, the dog, muzzled, was held up and stabbed in the neck several times with a dagger. The dog yelped and screamed as it was stabbed and bled out to death.

The pig and the chickens soon followed the fate of their comrades.

As the cow bled out, the blue plastic bucket was held to the wound to collect its blood. One of the cow’s ears and strip of hide were cut from the beast and tied to a section of the coconut palm leaf. The palm leave was then dipped in the blood and the blood splashed upon the totem.

Declarations were made about the new law. The village chief apologised to his foreign guests: “I see that our foreign guests have become upset at what they have witnessed today. This is our way.”

The next part of the process was the formation of a procession of all in attendance that walked to a tall tree in a prominent location in the village territory. The blood soaked palm leaf with the cow’s ear attached were placed in the tree as a sign that a new law had been made.

While absent from the village during this procession, the animals that had been slaughtered were prepared for eating.

It was at this point that my colleagues and I decided to leave. The prospect of eating dog meat was the most difficult concept to deal with.

This law-making process according to custom is a dramatic variation to the way that we are accustomed; the bloodless passage of a bill through Parliament. I record it for our edification. One other interesting aspect of this phenomenon is that it occurred in a village just outside Dili in the highlands back from the coast a little but just a short distance from where the formal law-making processes of the Parliament occur.

Serangan Seksual terhadap Anak, Hubungan Seksual Sedarah dan Pembunuhan Bayi di Timor-Leste

Pendahuluan
Organisasi masyarakat sipil hukum dan keadilan Timor-Leste, JSMP, telah menerbitkan Ringkasan Kasusnya Pengadilan Distrik Dili Juli 2018. Laporan ini mencakup pengamatan atas proses pengadilan dalam dua kasus kekerasan seksual terhadap anak di bawah umur; dan satu melawan seseorang yang tidak dapat membela diri.

Beberapa hal khusus ketiga kasus ini diekstraksi di bawah ini.

Keputusan dalam Kasus Pertama
Pengadilan tidak membuktikan bahwa terdakwa menggunakan kekuatan atau ancaman ketika dia melakukan hubungan seksual dengan korban. Berdasarkan sertifikat baptis korban pengadilan menemukan bahwa korban berusia 14 tahun dan 3 bulan ketika insiden itu terjadi. Oleh karena itu pengadilan memodifikasi dakwaan dari Pasal 172 dan 173 KUHP menjadi tindakan seksual dengan seorang remaja sesuai dengan Pasal 178 KUHP.

Pengadilan menganggap bahwa terdakwa mengambil keuntungan dari pengalaman korban ketika ia melakukan hubungan seksual dengan korban. Berdasarkan dakwaan yang diubah ini dan pertimbangan-pertimbangan yang disebutkan di atas, pengadilan menjatuhkan hukuman kepada terdakwa tiga tahun penjara, ditangguhkan selama lima tahun, dan memerintahkan terdakwa untuk tampil secara berkala di pengadilan sebulan sekali selama satu tahun.

Keputusan dalam Kasus Kedua
Pengadilan membebaskan terdakwa dari dakwaan jaksa penuntut umum karena tidak terbukti bahwa terdakwa memiliki hubungan romantis dengan korban dan tidak terbukti bahwa dia melakukan hubungan seksual dengan korban meskipun korban berada di bawah tempat tidur terdakwa.

Kejahatan Pelecehan Seksual Ketiga Orang yang Tidak Mampu Melakukan Perlawanan
Saya menyebutkan kasus ini lagi karena paling tidak analog dengan pelanggaran seksual terhadap anak di bawah umur. Pengadilan menemukan bahwa terdakwa melakukan hubungan seksual dengan korban sebanyak tiga kali, meskipun terdakwa tahu bahwa korban mengalami cacat fisik di tangan dan kakinya. Sehubungan dengan bayi korban, pengadilan tidak menemukan bahwa bayi itu adalah anak terdakwa. Berdasarkan bukti ini pengadilan menjatuhkan hukuman 5 tahun penjara kepada terdakwa.

JMSP telah melaporkan secara teratur pada kasus-kasus lain seperti pelecehan seksual terhadap anak di bawah umur serta meneliti masalah sosial incest, yang kemungkinan besar melibatkan anak di bawah umur. ETLJB sering berusaha menarik perhatian pada masalah pembunuhan bayi dan inses.

Laporan Pembuangan Mayat Bayi yang Tidak Sah
Belakangan ini, ada dua laporan media tentang kasus-kasus mayat bayi yang ditemukan di tempat pembuangan sampah. Versi bahasa Inggris dari laporan ini tersedia di Timor Guide Post.

Kasus-kasus ini semua menunjukkan adanya masalah sosial yang paling serius: pelanggaran hak-hak anak pada tingkat tertinggi kejahatan. Terlepas dari pelecehan seksual anak di bawah umur yang masih ada di semua masyarakat, kejadian pembuangan mayat bayi ke tumpukan sampah (dan kemungkinan bahwa ada mayat lain yang telah dimakan oleh hewan atau dibuang oleh pembuangan sampah tanpa pemberitahuan) harus memaksa pembuat kebijakan dan pembuat hukum untuk memberi perhatian serius, dan bagi seluruh masyarakat untuk memeriksa hati nuraninya dan menyadari mengapa ini terjadi, dan bagaimana menghentikannya.

7. Analisis ROCCIPI Singkat
Ada beberapa hipotesis yang mungkin diajukan sebagai penjelasan dari fenomena ini seperti hubungan seksual sedarah (incest), pemerkosaan termasuk anak di bawah umur, pembatasan oleh tabu sosial dan agama yang mengatur baik seksualitas laki-laki dan perempuan, larangan agama pada penggunaan pengendalian kelahiran, ideologi larangan agama tentang seks pra-nikah dan homoseksualitas, stigmatisasi sosial seorang ibu muda dan kutukan oleh doktrin lembaga agama atau mungkin hanya kurangnya pendidikan seks yang memadai.

Ini harus dicatat dalam referensi untuk ideologi agama sebagai penyebab perilaku bermasalah, tindakan ini dalam pelanggaran mendasar terhadap ajaran lembaga agama pada kesucian hidup dan perlindungan anak-anak, yang juga kebetulan dinyatakan dalam hukum perdata. serta teologi dan katekismus tetapi juga konvensi internasional tentang hak-hak anak.

8. Para Pelaku 
Para Pelaku yang perilaku bermasalahnya adalah penyebab utama dari peristiwa-peristiwa ini dapat secara umum dikategorikan sebagai laki-laki dengan kelainan seksual dan disposisi kriminal tertentu, termasuk ayah dan kerabat laki-laki lainnya, unit keluarga di mana incest sering diam, dan institusi keagamaan. Kepentingan para korban adalah yang paling terpenting. Lembaga agama juga merupakan Para Pelaku utama.

9. Lembaga-Lembaga Pelaksana
Lembaga Pelaksana adalah polisi, jaksa penuntut umum, Pengadilan, pembela, dan CSO yang mengurusi perempuan dalam kesusahan seperti Pradet dan para Menteri dan Departemen terkait.

Sexual Assault of Minors, Incest and Infanticide in East Timor

1. Introduction
The East Timorese law and justice civil society organisation, JSMP has published its Case Summary The Dili District Court July 2018. The report includes observations on the court proceedings in two cases of sexual assault against a minor; and one against a person unable to defend themselves.

Some particulars these three cases are extracted below.

2. Decision in the First Case
The court did not prove that the defendant used force or threats when he had sexual intercourse with the victim. Based on the victim's baptism certificate the court found that the victim was 14 years and 3 months old when the incident occurred. Therefore the court modified the charge from Article 172 and 173 of the Penal Code to sexual acts with an adolescent pursuant to Article 178 of the Penal Code.

The court considered that the defendant took advantage of the victim's inexperience when he had sexual intercourse with the victim. Based on this amended charge and the aforementioned considerations, the court sentenced the defendant to three years in prison, suspended for five years, and ordered the defendant to appear periodically at the court once a month for one year.

3. Decision in the Second Case
The court acquitted the defendant from the charges of the public prosecutor because it was not proven that the defendant had a romantic relationship with the victim and it was not proven that he had sexual intercourse with victim even though the victim was under the defendant's bed.

4. The Third Sexual Offence Abuse of Person Incapable of Resistance
I mention this case again because it is at least analogous to the sexual offences against minors. The court found that the defendant had sexual intercourse with the victim three times, even though the defendant knew that the victim had a physical disability to her hand and foot. In relation to the victim's baby, the court did not find that the baby was the defendant's child. Based on this evidence the court sentenced the defendant to 5 years in prison.

5. Incidence of Sexual Assault of Minors and Incest
JMSP has reported regularly on other such cases of the sexual assault of minors as well as researched the social problem of incest, that most likely involves minors. ETLJB has often sought to draw attention to the problems of infanticide and incest.

6. Reports of the Unlawful Disposal of Baby Corpses
In recent times, there have been two media reports of cases of the corpses of babies being found in garbage disposal areas. English versions of these reports are available at Timor Guide Post.

These cases all demonstrate the existence of a most grave social problem: the violation of the rights of the child at the highest level of opprobrium. Apart from the sexual abuse of minors that is extant across all societies, the incidence of the disposal of the corpses of babies onto garbage piles (and the possibility that there are others that have been consumed by animals or removed by garbage disposal without notice) must compel policy makers and law makers to pay serious attention, and for the whole society to examine its conscience and realise why this is happening, and how to stop it.

7. Brief ROCCIPI Analysis
There are several hypotheses that might be put forward as elucidations of this phenomena such as incest, rape including minors, restrictions by social and religious taboos that regulate both male and female sexuality, religious prohibitions on the use of birth control, the ideology of religious prohibitions on pre-marital sex and homosexuality, the social stigmatisation of a young mother and condemnation by the doctrines of the religious institutions or perhaps just lack of sufficient sex education.

It has to be noted in reference to religious ideology as the cause of problematical behaviour, these acts are in fundamental violation of the religious institutions teachings on the sanctity of life and the protection of children, which also happen to be expressed in the the civil law as well as theology and the catechism but also international conventions of the rights of the child.

8. The Role Occupants
The Role Occupants whose problematical behaviour is the primary cause of these events may be generally categorised as men with a particular sexual aberration and criminal disposition, including fathers and other male relatives, the family unit within which incest is often kept quiet, and the religious institutions. The interests of the victims are paramount. The religious institutions are also a key Role Occupant.

9. Implementing Agencies
The Implementing Agencies are the police, the public prosecutor, the Courts, the defence, and CSO's taking care of women in distress such as Pradet and relevant Ministers and Departments.

10. Short Conclusion
Whatever the cause, it needs to be discovered by research and prioritised by policy makers and the Nation’s Government institutions and Parliament. A thorough analysis using the ROCCIPI methodology would assist the formulation of policy, map the patterns of problematic behaviour and propose solutions.

Committee F of the National Parliament appreciates JSMP's findings obtained from monitoring at the National Parliament and will give consideration to certain issues that are related to the competence of the Committee

On 27 September 2018 the JSMP had a meeting with Committee F of the National Parliament which deals with Education, Health, Social Security and Gender Equality. The aim of this meeting was to present the results and findings of monitoring conducted by JSMP over 8 years at the National Parliament.

The issues raised by JSMP in this meeting included a National Legislation Program, issue of interpreting immunity for members of Parliament and members of Government and the need to draft guidelines for interpretation, the issue of punctuality and discipline of the members of parliament, the issue of unjustified absences, the issue of draft laws that should be available in Tetum and Portuguese, the issue of pending and expired laws such as the Law Against Corruption, Law on a Bar Association and Law on Child Protection, the issue of amending existing laws such as the Law on a Monthly Lifelong Pension to address the issue of “established rights”, the issue of the Penal Code criminalising incest and the Civil Code including religious faiths other than Catholicism. In addition, JSMP also mentioned adequate space or facilities for MPs at the National Parliament.

Iha 26 Setembru 2018, JSMP realiza treinamentu kona-ba demokrasia, kna’ar órgaun soberanu sira-nian, partisipasaun públika iha prosesu halo lei no asesu ba justisa formál ba grupu “Lesbian, Gay, Bisexual and Transgender (LGBT) iha Postu Administrativu Manatuto Vila, Munisípiu Manatuto.
