Final decision issued by court in 11 February case fails to prove who shot the President of the Republic

On 3 March 2010 the Dili District Court issued a decision in the 11 February 2008 case, involving the attempted murders of the President of the Republic Ramos Horta and Prime Minister Kay Rala Xanana Gusmão. The attempted murders were allegedly carried out by armed groups led by former Major Alfredo Reinado and Gastao Salsinha.

As a result of the attempted murders President Horta and his bodyguard Celestino Gama suffered serious injuries at the residence of the President in Metiaut, and Major Reinado and Leopoldinho were shot dead at the scene. Prime Minister Xanana Gusmao escaped unharmed, but the car he was travelling in suffered serious damage as a result of shots fired in the Balibar area.

Many family members and sympathisers of the defendants were present for the announcement of the decision, as well as analysts, and members of the national and international media. A strong security presence was also provided by UNPOL GNR (National Republican Guard) as well as the Timor-Leste National Police (PNTL).

There were 28 defendants in this case, however only 24 of the defendants were found guilty of committing crimes and were respectively sentenced to terms of imprisonment ranging from nine years and four months to sixteen years, although some of them were acquitted from other charges. The remaining four defendants, including Angelita Pires, were acquitted due to a lack of evidence.

The court found the defendants guilty based on the facts presented during the trial, namely that the defendants together with the deceased Alfredo Reinado were illegally armed and travelled from Lauwala to the residence of the President to carry out attempted murder. However, the court found that the identity of the person who had injured the President and his bodyguard had not been established. The court also found that it had not been proven that Francisco Lino Marçal shot dead Alfredo Reinado and Leopoldino Expsoto. Amaro da Costa (also known as Susar) was named as the leader of the attacks made on the President, assisted by other defendants.[1] To da Costa, the court handed down a sentence of 16 years imprisonment for committing the crimes of attempted murder against a head of state[2] attempted murder[3] and illegal use of weapons.[4]

In its decision the court stated that a number of defendants[5] were found guilty of the crime of attempted murder,[6] the illegal use of weapons and the crime of destruction of property[7] in the form of transport belonging to the Prime Minister. These defendants were sentenced to 9 years and four months imprisonment. Gastão Salsinha was sentenced to 10 years eight months imprisonment for leading an illegally armed group[8] to carry out attempted murder against the Prime Minister and two bodyguards of the Prime Minister.[9]

The defendant Angelita Pires, who was charged as a principal actor in a conspiracy to commit attempted murder, was acquitted by the court together with three other defendants[10] due to a lack of evidence. The court decided not to order the defendants to pay court costs pursuant to Article 358.1 of the Timor-Leste Criminal Procedure Code.

JSMP believes that all parties are concerned by the lack of any evidence to indicate who shot President Horta, even though the medical report stated that President Horta was definitely wounded by a bullet fired from a HK 33 weapon used by the perpetrator.

JSMP is also concerned with the contradiction between evidence provided by the witness Francisco Marcal and the ballistic examination report about the bullets that caused the death of the former Major Alfredo Reinado and Leopoldino Exposto. The court relied on the ballistics report as evidence that the bullets that caused the deaths of the two aforementioned individuals were not fired by the weapon belonging to Francisco Lino Marcal, and the bullets that killed the two individuals were fired from different weapons.


Nevertheless, JSMP congratulates those who have worked carefully on this case to successfully avoid any confrontations in what may have been a politically charged environment. JSMP believes that this process can be used as a learning experience, and that where large scale and complex cases occur in the future everyone can have faith in the courts to find the truth and uphold justice. JSMP requests that all parties respect the court’s decision, and asks all parties to take advantage of all legal mechanisms available in accordance with the applicable law to lodge an appeal if they do not accept the outcome.

Putusan akhir dari Pengadilan atas kasus 11 Februari tidak dapat membuktikan pelaku penembakan atas Presiden Republik

Pada tanggal 3 Maret Pengadilan Distrik Dili menjatuhkan hukuman atau putusan terhadap kasus 11 Februari 2008 yang lebih dikenal dengan kasus percobaan pembunuhan terhadap Presiden Republik Ramos Horta dan Perdana Menteri Kay Rala Xanana Gusmão yang dilakukan oleh kelompok bersenjata pimpinan mantan Mayor Alfredo Reinado dan Gastao Salsinha. Percobaan pembunuhan ini mengakibatkan Presiden Horta dan Celestino Gama mengalami luka berat di kediamannya di Metiaut dan Mayor Reinaldo dan Leopoldinho tertembak mati di tempat. Selain Perdana Menteri Xanana Gusmao bebas dari bahaya tersebut namun mobil yang ditumpangginya mengalami rusak berat karena tertembak di wilayah sekitar Balibar. Pembacaan putusan terhadap kasus tersebut mendapat partisipasi maksimal dari keluarga dan simpatisan dari para terdakwa, peneliti, media internasional dan nasional. Demikian juga area pengadilan dijaga ketak oleh UNPOL GNR (Guarda Nacional da Republica) dan PNTL (Polisi Nasional Timor Leste).

Jumlah para terdakwa dalam kasus ini sebanyak 28 orang, namun hanya 24 terdakwa terbukti di pengadilan telah melakukan kejahatan dan dijatuhkan hukuman kepada masing-masing yang berkisar dari sembilan tahun empat bulan hingga enam belas tahun penjara, meskipun para tersanga dibebaskan dari tuduhan atas kasus lainnya. Semnatara itu, keempat tersangka lain termasuk tersangka Angelita Pires dibebaskan karena tidak terbukti.

Pengadilan mempertimbangkan fakta-fakta persidangan yang terbukti karena para terdakwa bersama almarhum Alfredo Reinado bersenjata secara ilegal dari Lauwala menuju kediaman Presiden Republik untuk melakukan percobaan pembunuhan, akan tetapi pengadilan tidak membuktikan siapa yang melukai Presiden dan salah satu pengawalnya Celestino Gama. Pengadilan juga tidak membuktikan bahwa saksi Francisco Lino Marcal yang menembak mati Alfredo Reinado dan Leopoldino Expsoto. Amaro da Costa alias Susar bersama dengan tersangka lain.[21] Namun pengadilan menjatuhkan 16 tahun penjara karena terbukti melakukan kejahatan percobaan pembunuhan terhadap kepala Negara[22], dan percobaan pembunuhan terhadap penjaga kediaman presiden[23] serta kejahatan menggunakan senjata secara ilegal [24].

Dalam putusannya pengadilan menegaskan bahwa para terdakwa[25] yang terbukti melakukan kejahatan percobaan pembunuhan[26], menggunakan senjata secara ilegal dan tindak pidana pengrusakan[27] atas sarana transpostasi yang digunakan oleh Perdana Menteri dengan hukuman penjara 9 tahun empat bulan, tetapi hanya Gastao Salsinha yang dihukum 10 tahun delapan bulan penjara karena memimpin kelompok bersenjata secara ilegal[28] untuk melakukan percobaan pembunuhan terhadap Perdana Menteri dan dua orang pengawal Perdana Menteri[29]. Sementara, terdakwa Angelita Pires yang sebelumnya dituduh sebagai aktor utama untuk melakukan konspirasi percobaan pembunuhan dalam kasus ini, di bebaskan oleh pengadilan bersama dengan tiga orang terdakwa lain[30] karena tidak terbukti. Selanjutnya pengadilan memutuskan untuk tidak menghukum para terdakwa untuk membayar biaya perkara berdasarkan pasal 353, No. 1.

JSMP memberikan selamat dan menyambut baik pihak-pihak yang terlibat selama ini dan berupaya keras terhadap kasus ini tampa menimbulkan konfrontasi apapun, meskipun kasus tersebut bernuansa politik. Oleh karena itu, JSMP menghimbau kepada semua pihak untuk menghormati putusan pengadilan tersebut meskipun ada pihak tertentu yang tidak dapat menerima putusan tersebut atau menganggap mencederai dan melukai kepentingan mereka. JSMP meminta kepada semua pihak untuk memamfaatkan segala kemungkinan dengan menggunakan mekanisme hukum melalui upaya hukum untuk melakukan banding jika tidak menerima putusan pengadilan tersebut.

JSMP percaya bahwa semua pihak merasa prihatin mengenai tidak adanya satu bukti yang menunjukan aktor yang menembak Presiden Horta, meskipun berdasarkan laporan medis mengatakan bahwa Presiden Horta benar-benar terluka karena peluru dari senjata HK 33 yang digunakan oleh terdakwa. JSMP berpendapat bahwa situasi seperti ini harus menjadi sebuah pelajaran, jika kasus berskala berat dan kompleks semacam ini terjadi lagi di masa mendatang, agar semua orang percaya bahwa pengadilan sebagai sebuah tempat untuk menemukan dan mendapatkan kebenaran dan menegakan keadilan. .

JSMP juga berprihatin mengenai kontradiksi bukti antara pernyataan saksi Francisco Marcal dengan laporan pengujian balistik mengenai peluru yang mematikan mantan Mayor Alfredo Reinado dan Leopoldino Exposto. Pengadilan lebih mempertimbangkan pengujian balistik sebagai bukti bahwa peluru yang mematikan kedua almarhum bukan berasal dari peluru senjatanya Francisco Lino Marcal, dan peluru yang mematikan kedua armarhum dari senajata yang berbeda.
